End User License Agreement

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and the developers of Baldy (“Company”, “We”, “Us”, or “Our”) governing your use of the Baldy mobile application (the “App”).

1. Nature of the App (Important: Medical Disclaimer)

Baldy is not a medical device and does not provide medical advice.

The App is designed solely for informational, cosmetic, and wellness tracking purposes. The metrics provided (such as “Hair Health Score,” “Density,” or “Norwood Stage”) are estimated using artificial intelligence and computer vision and are not clinical diagnoses.

• No Doctor-Patient Relationship: Use of the App does not create a doctor-patient relationship.
• Consult a Professional: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or hair loss treatment.
• No Reliance: Do not disregard professional medical advice or delay in seeking it because of something you have read or seen on the App.

2. Grant of License

Subject to your compliance with this Agreement, We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on an iOS device that you own or control.

3. Subscriptions and Payments

The App offers auto-renewing subscription options (“Premium Service”) to access detailed analysis and tracking features.

• Billing: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Management: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase.
• Price Changes: We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion.

4. User Content and Data

You retain ownership of any photos, images, or data you import or capture using the App (“User Content”).

• License to Us:By using the App, you grant Us a non-exclusive, worldwide, royalty-free license to process your User Content solely for the purpose of providing the App’s analysis features (e.g., sending data to our AI processing providers).
• Local Storage: We prioritize your privacy. Your scan images are stored locally on your device and are not permanently stored on our servers. Transient processing occurs via secure cloud functions.

5. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App to harass, abuse, or harm another person.
• Submit Content that is sexually explicit, violent, or jeopardizes the safety of you and the app.

6. Intellectual Property

The App, including its “Baldy” name, logo, design, text, graphics, and underlying code, is strictly the property of the Company and is protected by copyright and intellectual property laws.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE APP.

9. Governing Law

This Agreement shall be governed by the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions.
